TonoCam Terms of Service

1. Acceptance of These Terms

These Terms constitute the agreement between you and the TonoCam Team regarding your use of the TonoCam app (the "App"). By downloading, installing, or using the App, you confirm that you have read, understood, and accepted these Terms; if you do not agree, stop using and uninstall the App.

These Terms also apply to the App's Camera Control extension (Control Center / Lock Screen camera control widget).

2. Service Description

TonoCam is a native iPhone toning-camera app that provides:

1. Capture: photo, Live Photo, and video capture, live viewfinding, and lens-capability detection (enabled according to the lenses and formats actually supported by your device; unsupported options are not shown);
2. Looks: classic color and monochrome looks with continuous 0–100% strength control;
3. Gallery: a local gallery with thumbnails, detail view, zoom, import, and sharing;
4. Digital negatives: original files plus editable recipes, with non-destructive re-rendering into new versions;
5. Membership: free and Pro benefits (see Section 5).

Product capabilities are limited by device hardware, lenses, and system version; the App enables features according to actual device capability and never fabricates non-existent lenses, formats, or pixel counts. Unverified capabilities are not promised as available features.

3. Accounts

The App provides no account system. No registration or phone number, email, or other information is required for core features.

4. Free vs. Paid Boundaries

• Free benefits: unlimited original photos / original Live Photos; standard-resolution photos; preview of all built-in and imported filters; 3 filtered photos / filtered Live Photos per local calendar day (originals and previews do not consume quota);
• Pro benefits: unlimited filtered photos / filtered Live Photos; 24/48MP, DNG RAW / RAW+JPEG, Apple ProRAW, JPEG-XL, and TIFF where device capability allows; filter strength and granular controls (grain, vignette, soft light, sharpness); color wheel; re-rendering from the negative master; negative exposure/color temperature/HSL editing; batch recipes; and more;
• The exact scope of benefits is as displayed in the App and on the Apple App Store product page for the current period; these Terms neither expand nor narrow that scope.

5. Membership, Subscriptions, and Purchases

1. Products: TonoCam Pro offers a monthly auto-renewing subscription, an annual auto-renewing subscription (including a 1-week free trial, subject to Apple's actual configuration for the product and your account eligibility), and a lifetime buyout (non-consumable, non-renewing). Reference prices: China region CNY 18/month, CNY 68/year, CNY 168 lifetime; US and all other regions US$3.99/month, US$14.99/year, US$34.99 lifetime. The actual billing currency and price are as displayed in the App Store for the current period;
2. Payment and receipts: purchases are completed through StoreKit on the Apple App Store and are subject to Apple's paid-services terms; we do not touch your payment account information;
3. Auto-renewal: monthly/annual subscriptions auto-renew and are charged within 24 hours before expiry; the renewal price is the price displayed in the App Store at renewal time. You can cancel renewal at any time in your Apple account settings; cancellation takes effect at the end of the current subscription period;
4. Restore purchases: after changing devices or reinstalling, you can restore valid entitlements under the same Apple account via "Restore Purchases" in the App;
5. Refunds: refunds are handled by Apple under its policies; we do not process refunds on your behalf;
6. Free trial: an Apple account that has already used the trial for the same subscription group is not guaranteed another trial; if the trial is not canceled before it ends, the subscription auto-renews;
7. A lifetime buyout does not cancel existing subscriptions: purchasing the lifetime product does not automatically cancel your existing monthly/annual subscription; cancel it in your Apple account settings;
8. Daily trial counter: the free filter quota is counted in the on-device keychain and resets on the local calendar day; this counter has no trusted network time source and cannot be claimed to prevent all device time, timezone, or system tampering; if the counter is unreadable or corrupted, the App shows an error and does not silently grant extra uses.

6. What "Lossless" Really Means for Digital Negatives

• A digital negative = original file + complete editable recipe, re-rendered from the same master, avoiding repeated filtering and compression on already-compressed outputs;
• "Lossless" refers to an export chain that adds no further lossy compression (such as TIFF LZW or JPEG-XL at quality 1.0); it does not mean turning a JPEG back into sensor RAW; highlights, color depth, and noise already discarded in a JPEG cannot be recovered;
• RAW offers more room for exposure and white-balance adjustment, but the actual decoder capability defines the available development-parameter range.

7. Works and Content

1. Ownership: rights to works you capture or edit with the App belong to you (or the original rights holder); the App only processes these contents locally on your device and acquires no rights in your works;
2. Imported content: for photos added through the import feature, you are responsible for holding the corresponding rights; the App processes them locally as you choose and does not scan your entire photo library;
3. Sharing: exporting works through the system share sheet is subject to the rules of the destination platform you choose;
4. Unlawful content: you may not use the App to create, store, or distribute content that violates applicable laws or regulations.

8. Intellectual Property

• The App's name, interface design, look designs, filter system, recipe format, and documentation are owned by the TonoCam Team or the respective rights holders;
• Brand independence: TonoCam is an independently developed product with no authorization, sponsorship, or affiliation with any camera, imaging, or lens manufacturer (including but not limited to Leica and Xiaomi); any third-party trademarks mentioned are for descriptive purposes only and remain the property of their owners;
• Without permission, you may not copy, modify, or distribute the App, reverse engineer or decompile it, or remove or obscure any rights notices.

9. Research Features and Models

The App's image-enhancement research features depend on lawfully usable local models and are off by default; when models are unavailable, incompatible, or resources are insufficient, baseline capture and existing works are unaffected. The App does not claim to reproduce any manufacturer's official private algorithms, and heuristic looks are never presented as model outputs.

10. Third-Party Services

The App uses Apple system services (camera, photo library, StoreKit, share sheet, etc.), which are subject to Apple's terms and policies; the App is also governed by the Apple Media Services Terms and Conditions and the Apple Standard End User License Agreement (EULA): https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.

11. Changes and Termination

1. We may adjust features, benefits, or prices through version updates; material changes will be announced in the App or on the release page in advance;
2. You may stop using and uninstall the App at any time; uninstalling removes the App's sandboxed local data, so export works you need to keep beforehand;
3. If you violate these Terms or applicable law, we may restrict or stop your use of related features.

12. Disclaimers and Limitation of Liability

1. The App is provided "as is". Capture capability and output quality vary with device hardware, lenses, system version, temperature, and available resources;
2. We work to ensure works are never silently discarded (original files are saved before processing), but we are not liable for data loss caused by force majeure, system failures, insufficient storage, or third-party service anomalies; please export important works promptly;
3. Free-trial counters and entitlement validation depend on the device and Apple's systems and are not claimed to prevent all tampering or fraud;
4. To the extent permitted by law, our aggregate liability is limited to the amounts you paid for the App in the most recent 12 months.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the People's Republic of China (excluding conflict-of-laws rules). Disputes arising from these Terms shall first be resolved through friendly negotiation; if negotiation fails, either party may bring a lawsuit before the people's court with jurisdiction at the operator's location.

14. Updates to These Terms

When we update these Terms, we will publish the new version and update the version number and effective date. Material changes will be prominently highlighted; your continued use after a change takes effect constitutes acceptance of the updated Terms.
